Publication Open Access Guidance for Irish Mental Health Services on the Adoption and Implementation of a Human Rights-Based Approach to Care and Treatment(Mental Health Commission, 2025-10-15)Scope: This guidance applies to all those involved in mental health care in Ireland in a professional capacity, including service providers, policymakers and practitioners. It is relevant to mental health services across the public, voluntary and independent sectors. It includes services for children and adolescents, adults, older persons, individuals with intellectual disabilities and mental illnesses, and forensic mental health services. The focus of this document is on enabling the rights, independence and dignity of service users, while ensuring they receive high-quality, respectful, transparent, inclusive, accessible and person -centred care that is free from stigma. This guidance document: Explains the legal basis for a human rights approach in mental health care -- Outlines key principles and international frameworks that support this approach -- Provides practical steps for applying human rights in everyday practice -- Includes case studies demonstrating how these principles work in real-life situations -- Recommends ways to improve autonomy, inclusivity, dignity, person-centred care and transparency while reducing stigma in mental health services.
